1.What’s the News?
As per the Finance Act, 2023, a new rule has been implemented from 1st October 2023.
According to this rule, GST returns cannot be filed after 3 years from their original due date.
2.Legal Reference:
Implemented via Notification No. 28/2023 – Central Tax, dated 31st July 2023.
Applicable under Section 37, 39, 44, and 52 of the CGST Act.
3.Which Returns Are Affected?
This 3-year limit applies to:
GSTR-1, GSTR-1A
GSTR-3B
GSTR-4, GSTR-5, GSTR-5A
GSTR-6, GSTR-7, GSTR-8
GSTR-9, GSTR-9C
4. What Does This Mean?
If you miss filing a return, you now have only 3 years to file it.
After that, the GST portal will not allow you to file that return at all.
5.Act Now:
If you have any old pending GST returns, file them immediately.
After the 3-year mark, you lose the chance forever—leading to penalties, notices, and non-compliance.
